First thing you need to do is get your fire escape inspected by a Certified Inspector. They will preform a thorough detailed inspection where they will take pictures, videos and notes on the condition of your fire escape. Once completed they will issue a Pass or Fail Certificate.
The first step is to get your fire escape inspected by a Certified Inspector to identify the condition of the violations. The Inspector will send you a proposal with options to repair that violation and bring your fire escape up to code.
If you can visibly see any of the following: rust, flaking paint, and or missing bolts this would be the first indication that you should get your fire escape inspected.

Fire Escapes are required by the International Building Fire code 1104.16.5.1. All fire escapes must be examined for structural integrity by a Certified professional every 5 years. An inspection report needs to be submitted to your local municipality.
